Emergency Physicians Insurance Exchange Risk Retention Group

March 2024 Update

Emergency Physicians Insurance Exchange Risk Retention Group (Epix or the Company) was placed in rehabilitation by order of the Vermont Superior Court, Washington Unit, on February 26, 2021. Docket No 21-cv-348.

The Court appointed Commissioner Gaffney as Rehabilitator and directed that he implement a plan of rehabilitation.

  • That plan contemplated a runoff of EPIX obligations, including the payment of policyholder-level claims at an initial 40% rate, pending conversion to liquidation.
  • That conversion occurred on February 6, 2024, when the court entered its Order of Liquidation.
  • That Order directed the implementation of the Plan of Liquidation.

The proceeding is being conducted pursuant to 8 V.S.A. Chapter 145.  Key documents from the rehabilitation and liquidation are posted below.
