CAPTIVE INSURANCE

TEMPORARY NOTICE DURING WORK FROM HOME RESTRICTIONS:  Notarization on applications, biographical affidavits, forms and other filings
  • Documents requiring a notarized signature will be accepted without a notary, electronic signatures are acceptable, and  notarized documents should be submitted at the first opportunity a notary is available or accessible.  If you are able to obtain a notary by any of these alternate means, no follow-up submissions are required:
  • We will accept e-notarized documents from out of state if that state allows e-notarization. 
  • The Vermont Secretary of State just adopted an emergency rule which allows for notarial acts to happen in Vermont by remote means through a secure audio-­visual communication link, i.e., webcam notarization. The notary and person making the oath are essentially connected and talking face-to-face electronically over a secure link while, for example, the oath is being administered.  There are a number of technology companies that offer end-to-end remote notarization systems. All filings must be submitted electronically in combined single PDF unsecure format and no Zip files are accepted.

All captive filings should be submitted electronically to:

► dfr.captivemail@vermont.gov - for captive mail correspondence requiring regulatory approval (including but not limited to change of business plan, 5-yr pro forma, permitted practice, loan, dividend, waiver or extension); or general notifcations (including but not limited to change of officer/director, change in service provider)

► dfr.captivefinancialfilings@vermont.gov - for captive financial filings (including but not limited to all NAIC and non-NAIC/Vermont domestic related regulatory financial filings, supplemental filings, audited financial statement, actuarial filing, ownership [parent] financials, reinsurer financials) 

IMPORTANT: For Vermont domestic email correspondence please indicate the Vermont License #/Captive Name in the subject line (for all Foreign RRGs please indicate the NAIC#/Captive Name and for Risk Purchasing Groups please indicate company name and assigned #).  Please submit all materials as unsecure with PDFs for same related correspondence combined as one complete file.
