When an out-of-network ambulance service provides emergency medical treatment to a member, the Department’s view is that Vermont law requires the health insurer to reimburse the ambulance provider directly for the cost of the services rather than sending payment to the member.

The purpose of this bulletin is to clarify the Department of Financial Regulation’s position regarding the underwriting of individuals who seek to acquire auto insurance coverage after cancelling or suspending their coverage during a military deployment or overseas assignment.
The Department is aware that at least one insurer is rating such individuals in the same class as those who have a gap in their coverage for reasons unrelated to military deployment or overseas assignment.

This bulletin is intended to ensure that healthcare providers are able to focus attention on providing care to Vermonters during the COVID-19 pandemic, rather than responding to routine audits.
In light of the emergent nature of COVID-19’s spread, the Commissioner is taking this action under 8 V.S.A. § 11(a)(2) and 18 V.S.A. § 9401(a) to ensure that all members of health insurance plans regulated by the Department have access to the care they need, and that providers are able to focus as fully as possible on providing that care.
This bulletin is intended to ensure that health insurance plans regulated by the Department of Financial Regulation continue to provide access to prescription drugs during the COVID-19 pandemic. This bulletin applies to health insurers, as that term is used in 18 V.S.A. § 9402, and pharmacy benefit managers, as that term is used in 8 V.S.A. § 4089j.
